EU confirms plans to renew Motor Vehicle Block Exemption Regulations: Will UK follow suit?

EU Announces Plans To Renew MVBER: Will The UK Follow Suit?The European Commission has confirmed plans to extend the Motor Vehicle Block Exemption Regulations (MVBER) until 2028.

It’s currently due to expire on 31 May next year but, provided the proposed five-year extension is implemented following an ongoing review process, independent garages within the EU will be able to continue operating as they have done since the current version was implemented in 2010.

The same does not apply here in the UK, though. We adopted the MVBER when we left the EU in 2020, but our version still hasn’t been renewed - meaning it’s set to expire in little over a year’s time.

The importance of MVBEROrganisations like the Independent Automotive Aftermarket Federation (IAAF) are calling on the Government to amend and renew the regulations in advance of the 31 May 2023 deadline, as they provide a great deal of protection for independent garages.

For example, they allow such businesses to service and repair new vehicles without voiding the manufacturer warranty, and make it compulsory for OEMs to sell parts to independent firms.

IAAF Chief Executive Mark Field commented: “We welcome the news from the European Commission and will lobby the UK government to follow suit. We shall also call for greater enforcement of the regulations as the reality is that there is a lack of understanding on the interpretation of the legislation, with many issues falling into ‘grey areas’ or being applied incorrectly.

“This is not in the spirit of the legislation and co-operation needs to happen so that motorists can continue to access local and affordable independent garages that have access to the right parts, tools and technical information.

“Lack of cooperation, prevention of access and unreasonable costs all place additional barriers and burdens on the aftermarket in its position as the leading provider to motorists for service, repair and maintenance of vehicles. Ultimately, the motorist loses out and we will make this clear to the government through our work as part of UK AFCAR.”
